Terms and Conditions

For the customer version the following terms and conditions are valid:

License Agreement APPLICATOR for Product SELECTION, CD-ROM and downloads from a proprietary Internet page of one of the Endress+Hauser Group Companies.

The present software and the attached documentation referring and relating to the software and providing information about products of the Endress+Hauser Group was in total developed from and in the name of Endress+Hauser Flowtec AG, Kaegenstrasse 7, CH-4153 Reinach (BL), Switzerland. Endress+Hauser Flowtec AG is part of the Endress+Hauser Group and owns all rights relating to and maturing from the software and from the documentation; it has such rights at its disposal and may prosecute, defend and execute them or have them executed.

 

With this software and the attached documentation the end-user is vested with the right to install the software in whole or in part as well as the right to use the installed software and the documentation accordingly, provided that the end-user has accepted the terms and conditions of this agreement.

 

This software comprises a so-called basic part and so-called additional modules. The license and right to use the basic part is granted free-of-charge. The right to use one or all additional modules is subject to payment. The additional modules will only be installed in the course of a particular type of installation. The attached documentation is valid and applies to the particular software version which is mentioned and marked in the documentation only.

 

The software, the included online texts, and the attached documentation were developed while applying the best technical knowledge and due diligence. Despite all due care and attention, the software, the included online texts, and the associated documentation cannot be guaranteed to be completely free of errors, faults or omissions..

 

This software is intended to provide information about all products of the Endress+Hauser Group for clients, customers of Endress+Hauser Group and all other interested persons. This software should serve as an aid and assistance for projecting new measurement installations and to help to decide about how to upgrade already existing process measurement installations. This software also facilitates and helps in preparing the ordering and purchasing of projected and desired devices. Particular attention is drawn to the fact that this software is not intended and cannot substitute a real order of the desired devices from Endress+Hauser.

 

The software and the attached and distributed documentation is subject to various copyright restrictions and other legally binding terms and international agreements which are applicable in the countries where the software is installed and used. The aforementioned rights to use this software explicitly forbid the making of unauthorized copies, reproduction in part, reassembly, modification as well as the marketing of this software and the accompanying documentation in the name of or for the benefit of the end-user. Endress+Hauser Flowtec AG reserves its rights to prosecute or have prosecuted any misconduct or violation of the above stated conditions, in particular any violations of the copyright restrictions. It should be noted explicitly that any violation of the copyrights or other illegal actions against the laws and terms for the protection of the author's rights may result in severe punitive or civil consequences.

 

Everyone who would like to have a copy of this software and/or of the accompanying documentation may and should address to and contact the owner Endress+Hauser Flowtec AG, Switzerland, or any other company or representative of the Endress+Hauser Group. Copies of recent and actual versions of the software and of the accompanying documentation are in each case available at Endress+Hauser Flowtec AG.

 

Endress+Hauser Flowtec AG, Switzerland, reserves its rights to modify, complete, and correct the software and the accompanying and attached documentation without any prior notification to an end-user. No-one has a basic or guaranteed right for free delivery or automatic provision of the newest software version, update or upgrade of the software, or of an accordingly modified documentation. All terms and conditions of this agreement apply correspondingly to each and every new software version, update or upgrade of the software provided and to the attached modified or corrected documentation.

 

The usage of this software and in particular the usage of any facts and results provided by this software are at the discretion and lie in the responsibility of each end-user. In no case will Endress+Hauser Flowtec AG, Switzerland be liable for any fault, defect, and error in the software, or in the contained online text, or in the attached documentation, or for any damage or consequence resulting from such defects or faults. In particular Endress+Hauser Flowtec AG will not accept any liability for damages that result from the installation of the software, from the usage of the software or documentation, from calculations provided by the software, or from any data or databases that come with this software. In no case is Endress+Hauser Flowtec AG obliged to compensate for any damages caused by the usage of the software or documentation.

 

This software may be used to create order codes for products or spare parts thereof manufactured by the Endress+Hauser Group or for any other device that is available from the Endress+Hauser Group. All such order codes created or resulting from the usage of this software are deemed to be just inquiries addressed to the Endress+Hauser Group to quote for the desired devices. Only a responsive and definite quotation by a company or representative of the Endress+Hauser Group will result in an effective order.

 

This agreement is construed in accordance with the laws of Switzerland and other applicable and legally binding terms and conditions of other countries and in particular in accordance with internationally agreed conditions and terms on copyright restrictions.
